Recent Activity in the Court Martial Appeal Court of Canada

‘Tis the season for end-of-year recaps.  But in advance of the annual year-end review of developments in military law, there are some (relatively) recent judgments from the Court Martial Appeal Court of Canada (CMAC) that bear mention.  In particular, in November and Early December, the CMAC handed down three judgements, each of which merit some commentary:

 

However, ‘tis the season for busy days, so I trust that you’ll forgive me if I recycle some commentary offered on the Global Military Justice Reform Blog, curated by my American friend and colleague, Gene Fidell, and to which I contribute from time to time.

Specifically, my friend and colleague, Dr. Pascal Levesque offers some pertinent commentary on the judgments in Kohlsmith and Meeks.

And I provide a review of some of the key elements in R v J.L., which concerned the application of the Code of Service Discipline to ”young persons” (i.e., people under 18 years of age), who are members of the Canadian Forces.
